Terms & Conditions
By booking and paying for a tour with Diogo Cunha Matos Unipessoal LDA you agree to and accept the following terms and conditions. This agreement is between you, the participating passenger, and Diogo Cunha Matos, Unipessoal LDA.
All personal details are compulsory in the registration form.
The participants minimum age is 18 years old.
Diogo Cunha Matos, Unipessoal LDA reserves the right to make modifications, but only if these modifications do not change the essential services or due to unexpected and uncontrollable situations.
Images of your participation in our Tours are only used for publicity or promotional purposes as web site, flyers, brochures.
The client confirms that from a medical point of view, there is nothing that prevents him/her from going on a walking tour, beach tour or any other type of tour operated. We require that you communicate us any relevant medical aspects: allergies, disabilities, medical incapacities etc.
The excursions and trips we offer depend of the weather conditions and minimum required number of participants. These reasons can lead to a cancellation of the previous.
The cancellation will be valid the day we receive it.
- We will refund you 100% of total amount, when the cancellation is made 7 days before your scheduled tour date.
- Within less than 7 days before the tour, we do not refund. We recommend you to contract a travel insurance.
No refunds will be made:
- In respect of any unused portion of a tour or partially completed trip.
- When the client is responsible for the incorrect delivery of the services.
- When the defective services are due to third parties or they occur in an unpredictable manner.
- When the services can not be provided, due to conditions beyond the control of the company. These are unusual and unpredictable conditions which could result in unexpected consequences such as natural disasters or meteorological aspects etc.
- When the incorrect delivery of the services is caused by happenings at Diogo Cunha Matos, Unipessoal LDA, even tough all the diligences are taken, but they still could neither be predicted nor prevented.
- Clients have to listen to the instructions of our staff and to follow Diogo Cunha Matos, Unipessoal LDA regulations. In case of not doing so and behaving irresponsible, the company will take the necessary measures, prior notification, such as the exclusion of the Services.
Although unlikely, tours, trips or week packages may be canceled/changed by Diogo Cunha Matos, Unipessoal LDA due to lack of the minimum number of participants or other unforeseen circumstances. Diogo Cunha Matos, Unipessoal LDA reserves the right to cancel/change tours, trips or week packages up but not less than 12 hours in advance. In the event a tour, trips or week packages is canceled/changed, you will be notified via email or phone.
In the event of a cancellation by Diogo Cunha Matos, Unipessoal LDA, we will offer our booked guests the following options:
- Re-schedule your tour to another date, if this is convenient with you.
- An alternative Tour will be offered as an option to you. A price difference may exist, if that is the case, you will be charged for any extra cost or refunded for any excess payment.
- A full-refund of any payments you have done to secure your booking for the Tour.
The client is always responsible for their own personal values, even if they left them on the car, bring them or be stolen. Diogo Cunha Matos, Unipessoal LDA or any member of Diogo Cunha Matos, Unipessoal LDA staff can’t be responsible for any damage and or lost of any kind / type of personal values of Diogo Cunha Matos, Unipessoal LDA clients. Like always Diogo Cunha Matos, Unipessoal LDA staff will do the best to help the clients to solve this situations, but with out any warranty.
Promotions and discounted fares
Any discounted fares, promotion fares, sale fares and package deals are non-transferable and non-refundable.
Promotional trips as prizes are non-transferable.
BOOKING TERMS & CONDITIONS
In order for Diogo Cunha Matos, Unipessoal LDA Partner Network to provide a professional level of service and cover the costs of arranging your travel requirements, the following booking conditions apply.
The following Terms & Conditions form the basis of your relationship with Diogo Cunha Matos, Unipessoal LDA Partner Network as an Marketplace (online promotor). Please read them carefully as they set out our bilateral respective rights and obligations. These Terms & Conditions apply to all bookings of individual travel components or services that you make with Diogo Cunha Matos, Unipessoal LDA Partner Network as set out in more detail herein.
YOUR BOOKING AND CONTRACT
To confirm a booking, the party leader must be authorized to make the booking on the basis of these Terms & Conditions as well as the Terms & Conditions of the supplier concerned by all persons named on the booking and their parent or guardian for all party members who are under 18 when the booking is made. By making the booking, the party leader confirms that he/she is so authorized. The party leader is responsible for making all payments due to us or the supplier concerned. The party leader must be at least 18 when the booking is made.
Once we have received your booking, we will, subject to availability, confirm your arrangements on behalf of the supplier concerned by issuing a confirmation. This confirmation will be sent to the party leader. Please check this confirmation carefully as soon as you receive it. Contact us immediately if any information which appears on the confirmation or any other document appears to be incorrect or incomplete as it may not be possible to make changes later. In case of unavailability Diogo Cunha Matos, Unipessoal LDA Partner Network will refund you 100% in less than one week.
We will take no responsibility for any errors in any documentation except where those errors are caused by us. Subject to this, we regret we cannot accept any liability if we are not notified of any inaccuracy in any document within 15 days of our sending it out. We will do our best to rectify any mistake notified to us outside these time limits but you must meet any costs involved in doing so.
A binding contract between you and the supplier concerned comes into existence when we send your confirmation on the supplier’s behalf to the party leader and the terms and conditions of the supplier, in addition to these conditions, will be applicable to the contract.

Diogo Cunha Matos, Unipessoal LDA Partner Network – offers and sells individual travel components and services separately to you. We act as an marketing agent and online promoter only in respect of all bookings we take or make on your behalf. For all bookings your contract will be established directly between you and the supplier/operator of the travel components or services and no contractual relationship between you and Diogo Cunha Matos, Unipessoal LDA Partner Network shall be established. You understand that where you have chosen more than one travel component or service, you will be entering into multiple contracts. As an Marketing agent and online promoter we accept no liability in relation to any contract you enter into or for any travel components such as accommodation and/or any other arrangements and/or any other travel services that you book or for the acts or omissions of any accommodation and/or transfer provider (“supplier(s)”) or other person(s) or party(ies) connected with the arrangements. The supplier’s (Operator(s)) terms & conditions, the supplier’s (Operator(s)) travel package description on our website and the individual offer description we have set up for you on behalf of the supplier will apply to your contract with the supplier. Copies of supplier’s general terms & conditions and the supplier’s travel package description are to be found on the trip detail pages of our website. If no supplier terms & conditions are to be found common travel laws will apply. Alternatively we will endeavor (but undertake no liability to do so) to make copies of the terms and conditions of the contracts you enter into available to you at your request. If the supplier terms are contradictory to the terms below then the terms below overrule the supplier terms.
All communications relating to your booking must be sent to us by email by the party leader quoting the booking reference.
Price quotations are subject to change without notice. If for any reason the price quoted is not correct, the team of Diogo Cunha Matos, Unipessoal LDA Partner Network will contact you for authorization. Tips/gratuities, baggage or personal insurance, beverages or food not described in the product’s description and all other purchases of a personal nature are not included.
All services must be pre-paid except otherwise stated.
Full payment by credit or debit card is required to make a reservation. Payment will be listed as TREKKSOFT*TOUR BOOKING on the credit or debit card statement. No refunds are available once a service has commenced, or in respect of any package, accommodation, meals or any other services utilized.
Trekksoft AG (www.trekksoft.com) is acting as an authorised agent of Diogo Cunha Matos, Unipessoal LDA Partner Network.
Final payment is due 60 days prior to departure unless otherwise advised. Please contact the Diogo Cunha Matos, Unipessoal LDA Partner Network Team after you have made any payments to verify the Company has received payment.
All cancellations must be made in writing and taken from the time at which the request in writing was received by Diogo Cunha Matos, Unipessoal LDA Partner Network.
a) Cancellation in case of unavailability Diogo Cunha Matos, Unipessoal LDA Partner Network will refund you 100% in less than one week.
a) Cancellation 120 days or more before scheduled departure – 100% of payment will be forfeited by the client
b) Cancellation between 61 – 119 days before scheduled departure – 30% of payment paid will be forfeited by the client
c) Cancellation between 31 – 60 days before scheduled departure – 50% of payment paid will be forfeited by the client
d) Cancellation between 0 – 30 days before scheduled departure – 100% of total payment paid will be forfeited by the client and the Company shall not be obliged to refund any monies whatsoever.
e) All Vouchers are non-refundable.
If you are eligible for a refund once a booking has been cancelled, the balance less any non-refundable amounts will be forwarded to you upon receipt of the refund from the applicable operator. Refunds take upward of 8 weeks to process. Refunds are not available for tours, accommodation, or any other services not utilised after travel has commenced.
You should wish to make an amendment to your booking after it has been confirmed you must advise us as soon as possible. Whilst we will try to assist you we regret amendment requests cannot always be met. Where an amendment can be made, any costs incurred by ourselves and any costs or charges incurred or imposed by any of the suppliers (operator)of your arrangements need to be paid by you. The minimum fee for booking amendments is 75 EUR.
If you change the number of people booked, the total price of your booking will be re-calculated for the new party size. If for example the party is reduced in number, this may mean that any accommodation you have booked is under-occupied and each of the remainder of the party may have to pay more.
MAIN CONDITIONS AND RESPONSIBILITY
Diogo Cunha Matos, Unipessoal LDA Partner Network shall not be responsible or liable for any death, disability, injury, damage, liability, loss, cost, expense, delay, inconvenience and/or loss of enjoyment which is or may be suffered or incurred by you or any other person or corporation caused or contributed to directly or indirectly by or arising from or in connection with:
1) you or any other person contravening or failing to comply with any laws, notices, instructions, tour information or itinerary provided by any Government, regulatory authority, the Company, tour operators, charter operators, hoteliers or carriers or otherwise any other act or omission of you or any other person, including being affected by alcohol or drugs, engaging in dangerous behaviour, being reckless, not taking adequate precautions or due personal care or otherwise entering into situations exceeding your or any other person’s abilities.
2) the inability of the Diogo Cunha Matos, Unipessoal LDA Partner Network, tour operators, charter operators, hoteliers or carriers to comply with any special request relating to age, medical conditions, physical ability or disability, dietary requirements, allergic conditions or smoking or non-smoking accommodation or seating;
3) negligence by, delay in or cancellation of services or any other act or omission of any airline, charter boat operation, land operator, transfer company or any other persons or company providing goods or services in respect to your booking arrangements; and/or
4) any force majeure or other events beyond the Company’s control, including but not limited to war, civil disturbance or unrest, terrorism, acts of government or any authorities, weather, tsunami, earthquake, wind, fire, flood, strikes or industrial action, illegal activities, accidents, failure of transport carriers, machinery or equipment;
Diogo Cunha Matos, Unipessoal LDA Partner Network is an online marketplace for and is not itself an airline, transport carrier, resort or hotel owner or operator, boat owner charterer or operator, transfer company or otherwise (a “Service Provider”) and as such has no control over any services or product provided by such Service Providers. You and your travel arrangements are subject to the terms and conditions and limitations of liability imposed by all Service Providers utilised by you, whether or not written notice thereof has been provided or shown to you.
Neither Diogo Cunha Matos, Unipessoal LDA Partner Network nor any of its representatives shall be liable to you or any other person in the event that, due to any reason whatsoever, satisfactory surf is not available, perceived or expected climatic patterns or oceanic occurrences do not occur, the surf is of too great a magnitude or is beyond your capabilities or comfort zones, or atmospheric or oceanic visibility is impaired or any sporting or leisure activity is too dangerous or is restricted. These matters are solely at your risk and you engage in all activities at your own choice at all times. Diogo Cunha Matos, Unipessoal LDA Partner Network and its Service Providers (operators) are not required to assess or monitor your capabilities or participation in any such activity nor advise or update you on any such matter.
Diogo Cunha Matos, Unipessoal LDA Partner Network and its Service Providers (operators) reserve the right, without liability or right of compensation, to prohibit or restrict any activity, or cancel or alter any service or itinerary, without notice, in their absolute discretion.
It is the responsibility of each Client to check all details of their itinerary against their instructions and advise Diogo Cunha Matos, Unipessoal LDA Partner Network within a reasonable time of any errors or discrepancies. If the Diogo Cunha Matos, Unipessoal LDA Partner Network does not receive notification of any errors or discrepancies, it will be assumed that all details are correct. All corrections requested not within a reasonable time or after the payment of any trip segment will be treated as a change to the booking and may incur consequential fees.
Diogo Cunha Matos, Unipessoal LDA Partner Network does not warrant, and is in no way responsible for the accuracy or completeness of any information given or statements made or implied by any employee, contractor, agent or representative of the company or any of its Service Providers.
Travel Insurance is mandatory for all travel arrangements and must include unlimited medical cover incorporating medical evacuation.
We act only as an online promotor for the supplier(s) (operators) concerned. Your contract for your arrangements is directly with the supplier(s) (operators) concerned. We accept no liability in relation to the arrangements themselves or for the acts or omissions of the supplier(s) (operators) concerned. For all bookings, the terms and conditions of the supplier will apply to your contract.
However, in the event that we are found liable on any basis whatsoever in relation to your booking our maximum liability to you if we are found to have been at fault in relation to any service we provide as agent for the supplier(s) (operators) concerned is limited to twice the cost of the booking in question. We do not exclude or limit any liability for death or personal injury which arises as a result of our gross negligence.
When you book with us, you accept responsibility for any damage or loss caused by you or any member of your party. Full payment for any such damage or loss must be paid direct at the time to the supplier(s) (operators) concerned. If you fail to do so, you will be responsible for meeting any claims subsequently made against us as a result of your actions. Suppliers (operators) reserve the right at any time to terminate your stay/transfer or that of any member of your party due to your misconduct, where justified in their reasonable opinion. No refunds will be given. Furthermore, neither the suppliers nor we shall be under any obligation whatsoever to pay compensation or meet any costs or expenses you may incur as a result of your stay/transfer being terminated.
SUPPLIERS & CONDITIONS
The services which make up your arrangements are provided by independent suppliers (OPERATORS). Those suppliers (OPERATORS) provide these services in accordance with their own terms and conditions. Some of these terms and conditions may limit or exclude the supplier’s liability to you.

The Parties’ rights and obligations are not governed by the United Nations Convention on Contracts for the International Sale of Goods.
